Is Using a Spy Camera Legal? 4 Things to Know

Chances are if you’re in the market for a spy camera (also known as hidden cameras or nanny cams) you may be wondering to yourself… is using a spy camera illegal? Or can I use one legally?

In most cases, using a spy camera is perfectly legal, however there are certain situations where video or audio recording may not be permitted, so it’s important to learn and understand the laws.

But before purchasing a hidden spy camera, first be sure you’re aware of the proper ways to use a spy camera (and what things to avoid doing).

1. Expectations of Privacy (Where NOT to film)

When it comes to using a hidden camera, the first thing to know is where you likely CAN and CANNOT use a video recording device.

In the US, generally federal and state laws prohibit video recording in places where people have a “reasonable expectation of privacy”. What that basically means is that if a person would reasonably assume they are in an area you would expect privacy - such as a bathroom, bedroom, changing room, etc - those areas are off limits for video recording.

That being said - that doesn’t mean you can’t place a camera in one of those locations in certain situations. For example, let’s say you are going on vacation and have valuables hidden in your bedroom dresser. No one is expected to be using that room while you’re away, so it’s generally going to be okay to use a camera in your bedroom at that time.

But on the flip side, if you have a camera in a guest bedroom (where your dog likes to sleep for example), and you go out of town, and have someone watching your home and staying in that guest bedroom while you are away, you would need to remove that camera from the room, because the person staying there would reasonably assume they expected privacy in that bedroom.

2. Legalities of Video Recording

When it comes to video-only recording (that is the capturing of visual images and video), the laws in the US are pretty lenient. In public, you can almost always record anywhere. So as long as you’re out and about, you can pretty much record wherever you want.

With regards to indoor recording however, the laws are a little stricter, but not by much. Above we mentioned that you cannot use cameras in areas where people have an expectation of privacy - like a bathroom or bedroom - but other than that - you can pretty much record anywhere indoors in your own home.

For example - want to place a hidden camera in your living room? Great! Home office? No problem! Den or study? Go for it! As long as those areas aren’t used for activities that would be considered “private” - you should be within your rights to place a camera there. It’s always good practice however, to let people know that you are using a camera just to be safe.

3. Legalities of Audio Recording

Audio recording is a much different legal area than video recording, which is why you need to pay special attention to how you use your spy camera, even in your own home.

Audio recording (even when it’s part of a video recording) is much more strict due to federal laws and state laws on when and how you can record another person. Laws vary by state, and generally fall into two categories - “one party” or “two party” consent.

In one-party consent states, at least one person being recorded must be aware of the recording. So even if 20 people are on the recording, as long as one person is aware of the recording, you should be compliant.

In two-party consent states however, ALL parties must be aware of the recording. So if five people are being recorded, they all must be aware of or consent to being recorded.

If you’re not sure which your state is, check the audio recording laws for your state before using a camera that is audio-enabled.If you want to be extra-cautious, most audio-enabled spy cameras allow you to disable audio recording, and simply record or stream video only.
